Department of Business, Enterprise & Innovation – Brexit Quick Guide

The Department of Business, Enterprise and Innovation published a new Brexit preparation resource, the ‘Quick Brexit Guide for Business’, a timely and concise resource for Irish businesses providing guidance in the areas of customs, tariffs and duties, currency and more.

 

Brexit and Certs of Origin- Chamber Update

No Deal Scenario

  • We recently received an update from colleagues in the UK regarding a meeting held with HMRC. We are informed that at present UK HMRC do not require Certs of Origin for goods arriving in the UK coming from third countries and are therefore not likely to require Irish goods arriving in the UK post Brexit/no-deal to be accompanied by a Cert of Origin.
  • We are informed also that in the event of a no-deal, client companies in the UK may request a Cert depending on their individual needs (re-exporting etc). This applies vice versa. Irish companies whose supply chain contains UK components may also need to apply for a Certs – this will depend on the needs of and requirements in the country of destination. In addition, companies using a Documentary Letter of Credit to finance shipments may be requested by the relevant bank to obtain a Certificate of Origin too. Should your members have questions about whether or not they will need a Cert of Origin, we advise that they examine their supply chain, check the requirements of destination third countries and also speak to their client/importer as to their own requirements.

Withdrawal Agreement Scenario

  • The status quo will continue as normal for the duration of the transition agreement

Future Trade Deal

  • In the event of a trade agreement between the UK and EU in the future, preferential movement certificates will likely be required but in Ireland, these documents are issued by Revenue, not Chambers.

In advance of the forthcoming European elections, the European Parliament has launched an information awareness campaign called ‘This Time I’m Voting’ which aims to promote the act of voting itself and engaging in the democratic process in a conscious and fully informed way.

In addition, the European Parliament has launched www.what-europe-does-for-me.eu – a forum in which you may find information on EU-funded activities throughout each region in Europe (including every county in Ireland).

Call for Case Studies – Irish businesses benefitting from EU Free Trade Agreements (FTAs)

During the recent Brussels working visit, Chamber Network delegates met with DG Trade, responsible for the EU’s common policy on trade, who are interested tin profiling Irish businesses in this area as case studies.

Irish Chambers were invited to provide case studies of Irish businesses who have benefitted from EU Free Trade Agreements (FTAs). The European Commission wants to promote the economic benefit of these trade deals to businesses.

DBEI Brexit Updates –Customs Transit Procedure Check for UK landbridge post-Brexit & Brexit SME Emergency Fund Increase

The Department of Business, Enterprise & Innovation have recently published two important notices for Irish businesses in relation to further preparations for Brexit:

  • Heather Humphreys TD Minister for Business, Enterprise & Innovation last week urged businesses to make sure they are ready to avail of the customs Transit procedure for moving goods through the UK landbridge post-Brexit. To avail of the Transit procedure, businesses will need to have a Revenue-approved comprehensive financial guarantee in place. This comprehensive guarantee is required as financial security to cover all potential and actual customs debts such as customs and taxes. Businesses can also receive online customs training through Enterprise Ireland’s website to find out more about key customs concepts, documentation and processes
  • Heather Humphreys TD Minister for Business, Enterprise & Innovation has announced that the Brexit emergency rescue fund for businesses is being increased from €20 million to €200 million. The Rescue and Restructuring Scheme aims to offer both rescue aid and temporary restructuring aid to SMEs in financial difficulty or experiencing acute liquidity needs

Comreg – New Outdoor Mobile Coverage Map

The Commission for Communications Regulation (ComReg) has recently made available an online outdoor mobile phone coverage map which allows consumers to check ComReg’s calculation of operators’ mobile phone coverage and signal levels at locations throughout the country. The mobile coverage map can be found on the ComReg website by clicking here.

Department of Business, Enterprise & Innovation – Future Jobs Ireland 2019 now launched!

Yesterday the Future Jobs Ireland programme was launched, a new skills initiative aimed at taking advantage technological change to boost productivity of businesses and enhance the skills of Irish workers.

Future Jobs Ireland will focus on five pillars in the areas of enhancing innovation and technological change, improving SME productivity, enhancing skills, increasing labour force participation and transition to a low carbon economy.

Call for Case Studies – Irish businesses benefiting from EU Free Trade Agreements (FTAs)

During the recent Brussels working visit, Chamber Network delegates met with DG Trade, which is responsible for the EU’s common policy on trade, are interested tin profiling Irish businesses in this area as case studies.

Irish Chambers were invited to provide case studies of Irish businesses who have benefitted from EU Free Trade Agreements (FTAs)- for example, companies who have exported to Canada, South Korea, Mexico, Japan, etc. The European Commission wants to promote the economic benefit of these trade deals to businesses.

CSR SMEs Case Studies

We have been asked by the Department of Business, Enterprise and Innovation’s CSR National Stakeholder Forum if we know SMEs who would have corporate social responsibility programmes or some element of CSR in their business.

DBEI Brexit Updates –Customs Transit Procedure Check for UK landbridge post-Brexit & Brexit SME Emergency Fund Increase

The Department of Business, Enterprise & Innovation have recently published two important notices for Irish businesses in relation to further preparations for Brexit:

  • Heather Humphreys TD Minister for Business, Enterprise & Innovation today urged businesses to make sure they are ready to avail of the customs Transit procedure for moving goods through the UK landbridge post-Brexit. To avail of the Transit procedure, businesses will need to have a Revenue-approved comprehensive financial guarantee in place. This comprehensive guarantee is required as financial security to cover all potential and actual customs debts such as customs and taxes. Businesses can also receive online customs training through Enterprise Ireland’s website to find out more about key customs concepts, documentation and processes
  • Heather Humphreys TD Minister for Business, Enterprise & Innovation has announced that the Brexit emergency rescue fund for businesses is being increased from €20 million to €200 million. The Rescue and Restructuring Scheme aims to offer both rescue aid and temporary restructuring aid to SMEs in financial difficulty or experiencing acute liquidity needs

Brexit and Certs of Origin- Chamber Update

No Deal Scenario

  • We recently received an update from colleagues in the UK regarding a meeting held with HMRC. We are informed that at present UK HMRC do not require Certs of Origin for goods arriving in the UK coming from third countries and are therefore not likely to require Irish goods arriving in the UK post Brexit/no-deal to be accompanied by a Cert of Origin.
  • We are informed also that in the event of a no-deal, client companies in the UK may request a Cert depending on their individual needs (re-exporting etc). This applies vice versa. Irish companies whose supply chain contains UK components may also need to apply for a Certs – this will depend on the needs of and requirements in the country of destination. In addition, companies using a Documentary Letter of Credit to finance shipments may be requested by the relevant bank to obtain a Certificate of Origin too. Should your members have questions about whether or not they will need a Cert of Origin, we advise that they examine their supply chain, check the requirements of destination third countries and also speak to their client/importer as to their own requirements.

Withdrawal Agreement Scenario

  • The status quo will continue as normal for the duration of the transition agreemen

Future Trade Deal

  • In the event of a trade agreement between the UK and EU in the future, preferential movement certificates will likely be required but in Ireland, these documents are issued by Revenue, not Chambers.

Marie Keating Foundation – ‘Back to Work After Cancer’ Booklet Breakfast Launch *Wednesday 25 February*

The Marie Keating Foundation is partnering with Chambers Ireland to launch a ‘Back to Work After Cancer’ guide for employees and employers on Wednesday 27 February at 7:30am in the Cliff Townhouse Hotel, St. Stephen’s Green.

This breakfast launch event will feature an address from Chambers Ireland President Siobhan Kinsella, as well as other speakers including:

Aquaculture Licences Appeals Board – Nomination of Candidates

Chambers Ireland has been invited to select at least two persons as candidates for appointment by the Minister for Agriculture, Food and the Marine as members of the Aquaculture Licences Appeals Board. We now request potential candidates and a maximum of 2 from any Chamber.

Chambers Ireland does not wish to find itself in the position of having to select between different candidates from the same Chamber. Therefore, if a Chamber proposes 2 candidates the nominations committee reserves the right to request the individual Chamber to decide which candidate they support as their number one nomination should the sub-committee not be able to nominate both. The process for selection will be that the Nominations Sub-Committee of the board of Chambers Ireland will review applications received for suitability, may need to shortlist candidates and may conduct an interview process.

Please enclose the following requirements with any nominations:

  • Nominee’s Curriculum Vitae
  • Nominee’s consent to be nominated by Chambers Ireland
  • Email/letter to Chambers Ireland detailing why the candidate, in the opinion of your Chamber, would be suitable for appointment

Department of Communications, Climate Action & Environment – Call for Input for the Draft National Energy and Climate Plan

Ireland’s final version of its National Energy & Climate Plan (NECP) 2021-2030 is to be submitted to the European Commission by 31/12/2019.

The Department has a consultation open for the final version of the NECP until 22 February 2019.

  • We recently received an update from colleagues in the UK regarding a meeting held with HMRC on Wednesday. Brazilian Embassy in Ireland – Opportunities to work with the Embassy for Future Events

European Commission – Extension of the Latin America IPR SME Helpdesk Contract

The European Commission has extended for another two years the Latin America IPR SME Helpdesk contract. These means that the following Helpdesk services will be available free of charge to all SMEs across the EU:

  • a confidential advice and assistance by IP experts on IP protection in Latin America
  • organization of training sessions and webinars,
  • publication of sectoral and country-information material on IP protection and enforcement

If your Chamber is organizing any events this year targeting specific Latin American markets, Chambers Ireland can provide training on IPR protection for Irish SMEs operating in Latin American Countries.

Council of the EU Rotating Presidency – Three EU Member Countries Scheduled as Presidency Holders from January 2019 to June 2020

On 1 January, Romania took over the rotating Presidency of the Council of the European Union from Austria.

In 2009, the Lisbon Treaty established a system whereby a trio of Member States consecutively hold the Presidency, agreeing on a common agenda over the course of 18 months, with each country preparing its own detailed six-month programme.

The Romanian Presidency is the first phase of this trio, with Finland due to commence the second phase in July 2019. The Presidency trio will be completed by Croatia from January-June 2020.

    The Low Pay Commission is inviting submissions from interested parties in relation to the National Minimum Wage; these submissions will inform the Commission in its consideration of the appropriate rate for 2020.

    Department of Rural & Community Development – Call for Input for the National Volunteering Strategy

    The Department of Rural & Community Development has launched a Call for Input (CFI) to inform and seek views from stakeholders on key topics under consideration to develop a National Strategy on Volunteering.

    The CFI aims to:

    • Inform stakeholders of the proposed volunteering strategy;
    • Seek views from stakeholders on what constitutes volunteering;
    • Invite comments and proposals on the CFI including additional and emerging considerations which may further inform the Strategy

    Department of Communications, Climate Action & Environment – Call for Input for the Draft National Energy and Climate Plan

    Ireland’s final version of its National Energy & Climate Plan (NECP) 2021-2030 is to be submitted to the European Commission by 31/12/2019.

    The Department has a consultation open for the final version of the NECP until 22 February 2019.

    Update for Members- Employment (Miscellaneous Provisions) Act

    Chambers may remember that throughout the course of 2018 we were closely engaging with the Department of Employment and Social Affairs and the Oireachtas on a proposed piece of employment legislation. That legislation is now law and contains several changes and new sanctions that may impact employers found not to be compliant. Peninsula Ireland have compiled an update for Chamber Members (see attached) on the new Act. Please circulate to members.

    In brief there are four new provisions (see below) and employers should review policies and practices to ensure they are compliant with the new law.

    1. Early issuing of five core terms of employment
    2. Zero-hour contracts abolished

    The Department of Rural & Community Development has launched a Call for Input (CFI) to inform and seek views from stakeholders on key topics under consideration to develop a National Strategy on Volunteering.

    The CFI aims to:

    • Inform stakeholders of the proposed volunteering strategy;
    • Seek views from stakeholders on what constitutes volunteering;
    • Invite comments and proposals on the CFI including additional and emerging considerations which may further inform the Strategy

    NCBI – Notice asking retailers to avoid purchasing touchscreen payment terminals

    NCBI (National Council for the Blind Ireland) is asking Irish retailers to hold off purchasing touchscreen payment terminals and instead continue to use the current keypad button devices.

    At present, touchscreen payment terminals in shops and supermarkets are not accessible to people who are blind and vision impaired, of whom there are over 50,000 in Ireland today.

    Touchscreen payment terminals can be made accessible, however until manufacturers who produce touchscreen payment terminals devise a new way of delivering accessible touchscreen solutions at a national level, NCBI are asking retailers to use the current keypad button devices.

     

    Save the Date – Enterprise Ireland – Eurozone Summit

    Join Irish business leaders and professionals at the Eurozone Summit. Hear from European leaders and participate in discussions on how Ireland can take advantage of the trade opportunities that the single, shared currency market was designed to create.

    The summit will take place Thursday, 21st February 2019 at the National Convention Centre, North Wall Quay, Dublin 1 from 8.30am to 2.00pm.

    Office of Government Procurement (OGP) – New Informative Videos on eTenders

    The Office of Government Procurement (OGP) have published two new informative videos on their YouTube Channel, providing information for prospective suppliers on interacting with eTenders – details and links to each informative video are below:

    • Registering for eTenders & creating alerts – this video looks at registering for eTenders, creating business alerts, and ensuring that details are kept up-to-date
    • eTenders | submitting a tender response – this video looks at using eTenders to participate in competitions, seek clarifications, and so on

     

    Legislative Monitor – 5 Year Minimum Expiry Date on Gift Vouchers

    Following the Irish Government Cabinet’s approval of the bill in December 2018, legislation is due to be published in the first months of this new year regarding the new 5 Year Minimum Expiry Date for Gift Vouchers.

    We will review this legislation upon its publication and contact the Network in due course on the key details of the legislation.
